Can Form I-907 Be Used With All Immigration Forms?

Premium processing cannot be requested for all immigration forms.

It is only available for certain petitions and applications, such as:

  • Form I-129, Petition for a Nonimmigrant Worker – for H-1B, E-1, E-2, E-3, H-3, L1, H-2B or R nonimmigrant visas
  • Form I-140, Immigrant Petition for Alien Workers — for EB-1 (E11, E12, E13), EB-2 (E21 NIW, E21 non-NIW), or EB-3 (E31, E32, EW3) visas
  • Form I-539, Application to Extend/Change Nonimmigrant Status — for F-1, F-2, J-1, J-2, M-1, or M-2 visas
  • Form I-765, Application for Employment Authorization

How Premium Processing Works

When you file Form I-907, USCIS commits to taking action on the petition or application within a certain timeframe.

This period can be:

  • 15 business days for most applications or petitions
  • 30 business days for Form I-765
  • 30 business days for Form I-539 when applicants are requesting a change of status to F-1, F-2, M-1, M-2, J-1, or J-2 nonimmigrant status
  • 45 business days for Form I-140 for E13 (multinational executive or manager) and E21 (national interest waiver) visas

Taking action includes:

  • Approval: The petition or application is granted.
  • Denial: The petition or application is rejected.
  • Request for Evidence (RFE): USCIS needs additional information to make a decision.
  • Notice of Intent to Deny (NOID): USCIS is considering denying the petition or application.

If USCIS does not take any action within the stated time windows, they will refund the premium processing fee.

For concurrent submission of your application and Form I-907, send both forms together in a single package or submit them online.

When filing Form I-907 separately, include a copy of the receipt number for the previously filed form.

  • The fee for Form I-907 when filed with Form I-129 for an H-1B visa is $2,805 for both paper and online applications.
  • For Form I-907 filed with Form I-129 for E-1, E-2, E-3, H-3, L-1, O, P, Q, or TN visas, the fee is $2,805 for paper applications. Premium processing is not available for electronic applications in this group.
  • The fee for I-907 when filed with I-129 for H-2B or R visas is $1,685 for paper filing. Currently, premium processing is not available for online filing.
  • For Form I-907 filed with Form I-140 for EB-1 (E11, E12, E13), EB-2 (E21 NIW, E21 non-NIW), or EB-3 (E31, E32, EW3) visas, the fee is $2,805. Premium processing is not available for online applications.
  • The fee for I-907 when filed with Form I-539 for F-1, F-2, J-1, J-2, M-1, or M-2 visas is $1,965 for both paper and online filing.
  • The fee for I-907 when filed with Form I-765 is $1,685 for both paper and online applications.
