With the Trump administration vowing to conduct the “largest deportation operation in American history,” there are growing concerns about Immigration and Customs Enforcement (ICE) officers targeting workplaces with immigrant employees.
A detailed article outlined the advice of several experienced immigration lawyers on how to respond in this situation.
Among the experts featured is Brad Bernstein, Managing Partner at The Law Offices of Spar & Bernstein. Here are some of his recommendations to employers and employees on how to respond effectively if ICE shows up at a workplace.
For employers:
- Assert your authority as an employer by stating ICE officers cannot enter the place without your permission.
- If they insist on entering non-public areas, politely request to see a warrant and if they cannot provide one, state they are violating your rights.
- If there is no warrant, encourage your staff to document the situation as proof of violation of rights.
- Once ICE officers leave, record details of the encounter for future legal reference.
For employees:
- You have the right to remain silent and not provide information about your immigration status.
- You have the right not to show your documents if ICE officers do not have a warrant.
- If ICE officers do not try to stop you, you can calmly leave your workplace, without trying to run.
- If you are asked to stand with your colleagues by an immigration status, you have the right to do so randomly.
- You have the right to ask for an immigration lawyer at any stage of your interaction with ICE.
“We understand how overwhelming it can be for immigrants to navigate the uncertainty of changing legislation while trying to work and build a life,” said Brad Bernstein. “That’s why we’re here — to provide support and protection every step of the way.”
