Being approached by Immigration and Customs Enforcement (ICE) officers in public can be an intimidating experience, especially under the new administration and a growing fear of mass deportation policies.
That’s why it is key to understand your rights and the actions to take to ensure your safety and legal protection.
In a video on social media that gained traction online, Brad Bernstein, Managing Partner at Spar & Bernstein, shared valuable advice on immigrants’ rights during encounters with ICE officers:
- You are not obligated to answer questions about your immigration status unless you are under arrest or detained.
- You are not required to show your papers unless the ICE officer has a warrant or a valid reason to believe you have violated immigration laws or committed a crime.
- You have the right to legal representation, and ICE is required to assist you in contacting a lawyer or local consulate.
Other legal recommendations include:
- Remaining calm to de-escalate the situation.
- Documenting the encounter on your phone, if possible.
- Carrying documents proving your immigration status with you at all times.
“Understanding and asserting your rights when stopped by ICE officials is vital,” says Brad Bernstein. “At The Law Offices of Spar & Bernstein, we are dedicated to protecting the rights of immigrants, providing comprehensive support and guidance to handle various situations with immigration authorities.”
