The recently approved Laken Riley Act, expands Immigration and Customs Enforcement (ICE) powers, allowing the detention of undocumented immigrants charged with certain crimes, such as theft, burglary, or shoplifting.
The Laken Riley Act, named after a student who was killed by an undocumented immigrant, has sparked a heated debate.
Many organizations, including the American Civil Liberties Union (ACLU), worry that it will threaten immigrants’ rights by:
- Bypassing normal judicial processes
- Putting Deferred Action for Childhood Arrivals (DACA) recipients at risk
- Endangering civil liberties
Brad Bernstein, Managing Partner at Spar & Bernstein, also shares concerns about the Laken Riley Act.
In a video, Brad Bernstein warns that it could lead to:
- Unfair detentions, even when the charges are not true.
- Detention for small offenses.
- Inability to use bail.
- Direct removal from the country.
“The Laken Riley Act will create new challenges for immigrants and their families,” says Bernstein. “At Spar & Bernstein, we aim to educate our clients about their rights and protect their futures by explaining options of obtaining legal status.”
