Schools in Texas — particularly those near the border — are taking a wait-and-see approach regarding President Trump’s mass deportation plans, which could affect 111,000 undocumented public school students.
Unlike schools in other parts of the U.S. that educate staff on privacy student rights and organize legal information meetings with parents, Texas schools are waiting to see how President Trump’s plans will unfold before deciding how to respond.
Actions promised by President Trump include:
- Ending guaranteed citizenship for children of undocumented parents.
- Ending a policy that currently stops immigration authorities from making arrests on school campuses.
- Using National Guard soldiers and local police to assist in mass deportation efforts.
As per Brad Bernstein, Managing Partner at Spar & Bernstein, school districts play a vital role in protecting immigrant students and their families.
They are not required to cooperate with immigration officers and should follow two key federal laws:
- The Supreme Court’s Plyler v. Doe decision, which prohibits denying education based on immigration status.
- The Family Educational Rights and Privacy Act (FERPA), which protects student records.
Bernstein also pointed out that immigration warrants by federal authorities carry less weight than judicial ones and that school districts should have clear policies to inform communities about the way they handle immigration-related matters.
“There should not be any misunderstanding about what a school district will do and will not do should immigration walk on campus, and whatever their policy is, it should not be a policy that some people follow and others don’t,” Bernstein said.
