New Federal Rule Requires Certain Noncitizens to Register with USCIS

As of April 11, 2025, a significant change to immigration policy has taken effect under Executive Order 14159, titled “Protecting the American People Against Invasion.” The U.S. Citizenship and Immigration Services (USCIS) has implemented a mandatory registration requirement for certain noncitizens currently residing in the United States. This includes, in many cases, the provision of biometric data such as fingerprints. 

This regulation is legally binding, and failure to comply could result in fines, imprisonment, or deportation proceedings.

Who Must Register? 

You must register if you fall into any of the following categories: 

  • You are a noncitizen aged 14 or older who was not previously registered or fingerprinted when applying for a U.S. visa and have been in the U.S. for 30 days or more. 
  • You are the parent or legal guardian of a noncitizen under 14 who has been in the U.S. for 30+ days and is not registered. 
  • You are a noncitizen who turns 14 while in the U.S.; you must register within 30 days of your birthday. 

This requirement also applies to individuals who: 

  • Entered the U.S. without inspection (i.e., without official immigration documents). 
  • Are Canadian visitors who entered through land ports of entry without receiving registration documentation (such as Form I-94). 

Who Is Already Registered? 

You are likely already registered if any of the following apply: 

  • You were issued a visa and fingerprinted upon entry. 
  • You received an Employment Authorization Document (EAD). 
  • You were granted lawful permanent residence (green card). 
  • You were issued Form I-94 or I-94W. 
  • You applied for immigration benefits and submitted biometrics using forms such as I-485, I-687, or I-698. 
  • You have been placed into removal proceedings by DHS. 

How to Register 

The process is entirely online and includes several steps: 

  1. Create a USCIS Online Account: Visit the USCIS website and create an account. Each person, including minors, must have their own account. 
  2. Submit Form G-325R: Complete and submit the Biographic Information (Registration) form through your account. This form cannot be mailed or submitted in person. 
  3. Attend Biometrics Appointment: If USCIS requires biometrics, you’ll receive an appointment at a local Application Support Center. Attendance is mandatory. 
  4. Receive Proof of Registration: Once complete, USCIS will issue Proof of Alien Registration through your online account. 

Penalties for Noncompliance 

Noncompliance with this registration requirement can carry serious consequences, including: 

  • Fines up to $5,000 
  • Imprisonment for up to 6 months 
  • Misdemeanor charges for failing to carry proof of registration, punishable by additional fines or up to 30 days in jail 
  • Removal (deportation) proceedings for failing to update your address with USCIS within 10 days of moving
